This was an' action for an injunction against the city of Olathe and its officers to restrain them from enforcing certain orders to open portions of certain *343■streets and alleys which had been inclosed by the plaintiff below. The trial court made the following findings of fact:
“1. The defendant is a city of the second class, duly incorporated and organized as such under the laws of the state of Kansas.
