Plaintiff Fedhia Gaillard (“plaintiff’) bring this personal injury action against defendants Bayer Corporation and Bayer Healthcare Pharmaceuticals, Inc. (“defendants” or “Bayer”), alleging that her exposure to Bayer’s radiology contrast dye, Magnevist, caused her to develop a disease known as nephrogenic systemic fibrosis (“NSF”). Plaintiff has voluntarily dismissed several claims and, thus, the only remaining claims are for negligence, strict liability-design defect, and strict liability-failure to warn.
