Appeal by the defendant, Samuel W. Peck, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 22d day of December, 1916, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 12th day of January, 1917, denying defendant’s motion for a new trial made upon the minutes.

Shearn, J.:

This is' an action at law brought by a tradeswoman against a married man for alleged necessaries furnished to the wife during coverture. The defense was in part, (1) that the merchandise was sold to the defendant’s wife exclusively upon her credit; and (2) that the defendant had furnished his wife with an allowance sufficient to pay for all necessaries.

The defendant contends that the court in effect charged the jury that the defendant was liable, if the articles sold were necessaries, irrespective of whether they were sold exclusively on the credit of the wife and that this was…
