Plaintiffs Ocean Partners, LLC and Battery Commercial Associates, LLC (collec tively, “Ocean Partners” or “Plaintiffs”) have brought suit against Defendant North River Insurance Company (“North River” or “Defendant”) to recover insurance proceeds for damages sustained to 17 Battery Place (the “Building”). North River had issued a first-party property insurance policy for the period January 26, 2001 to January 26, 2002 (the “Policy”).
