OPINION AND ORDER

LYNCH, District Judge.

Plaintiffs Beacon Hill CBO II, Ltd. (“CBO II”) and Beacon Hill CBO III, Ltd. (“CBO III”) (collectively, the “Issuers” or “plaintiffs”) initiated this lawsuit on November 19, 2002, seeking to terminate their relationship. with defendant Beacon Hill Asset Management LLC (“Beacon Hill” or “Portfolio Manager” or “defendant”), the entity that Issuers had contracted with to manage a certain portfolio of assets that Issuers own. Essentially, the First Amended' Complaint, filed on March 21, 2003, alleges that the Portfolio Manager breached its fiduciary duties…
