This case arises from the dismissal of a petition brought under the Post-Conviction Hearing Act (725 ILCS 5/122 — 1 et seq. (West 1992)). In 1990, defendant, Kathy Gaultney, was convicted of the first degree murder of her husband and was sentenced to 45 years in prison. The conviction and sentence were affirmed by the appellate court on direct appeal in 1992. No. 5 — 90— 0583 (unpublished order under Supreme Court Rule 23). Defendant filed a petition for leave to appeal to this court, which was denied. People v. Gaultney, 148 Ill. 2d 647 (1993).
