This appeal was brought by the State from the discharge of the defendant, Richard Burchfield, because of the failure of the State to bring the defendant to trial within 120 days of the date he was taken into custody. On September 1,1977, the defendant was arrested and placed in custody based on a complaint charging unlawful possession of a controlled substance.
