The defendant, charged with the unlawful possession of a narcotic drug as a misdemeanor, has moved to suppress the evidence allegedly seized by the police *37in violation of Ms constitutional rigMs. A hearing held in support of the motion disclosed that on September 27, 1962, at 1:00 p.m., the police officer observed the defendant in conversation with an unknown man at 4th Street and Avenue A, in this county.
