The defendant was indicted for murder, tried, and found guilty as charged without capital punishment. From a life sentence pursuant to the verdict, the defendant has appealed.

The accused was sentenced on July 24, 1906, and on the same day was granted an appeal to the Supreme Court, returnable according to law; that is, within 10 days. This court being in vacation, the transcript was not filed until October 3, 1906, on the third day after the commencement of the term.
