Appeal from Twelfth Judicial District Court, Parish of Vernon; John Bachman Lee, Judge. R. B. Mitchell was convicted of manslaughter, and appeals.

The defendant was indicted for murder, and found guilty of manslaughter. He appeals from a sentence of imprisonment for two years in the penitentiary.

The bills of exception on which defendant relies will be considered in their logical order.

lyThe defendant moved to quash the indictment on the ground that the grand jury had been illegally impaneled, in this: that the sheriff opened the envelope containing the names of the 20 grand jurors, and emptied the slips on which the names were writteu into an open box, and drew therefrom 11 names of jurors who with the foreman constituted the grand…
