The plaintiff below, Theodore Roy, brought an action against the Glenmont Dumber Company, a corporation, for alleged negligence which he averred caused him to fall upon a log carriage in the defendant’s sawmill, and to lose a part of *526his hand against the saw. There was a verdict and judgment for the plaintiff, and the alleged error in the trial is that the court below refused to instruct the jury to return a verdict for the defendant.
