ADAMS, Circuit Judge.

This was an action in the nature of trespass on the case by a servant 'for damages resulting from negligence of ;the master.;, The -defenses were the general issue, contributory negligejicg,JancL-assumption of risk. The -verdict and judgment *689below, from which the defendant prosecutes error, were in favor of the plaintiff. Ten different specifications of negligence are found in the petition, three of which only require consideration by us.
