FINDINGS OF FACT AND CONCLUSIONS OF LAW
Plaintiffs, Agrico Chemical Company and Continental Insurance Company, (hereinafter referred to as “Plaintiff” or “Agrico”), seek to recover for cargo damage and cargo shortage as a result of a collision between the moored Lash Barge CG-063 and a three Lash Barge tow that was at tempting to navigate through a narrow opening between Pontoons 1 and 2 of the Waalhaven Fleeting Area in Rotterdam, Holland.
