The validity of certain statutes hereinafter designated is involved in this proceeding. In the court below the cause was tried and determined upon an agreed statement of facts, and the trial court granted the writ of mandamus as prayed. From such order, this appeal was taken. Upon consideration here, the writer reached the conclusion that the court below was in error in granting the writ, and as the statute provides the question was referred to the Supreme Court.
