MEMORANDUM AND ORDER
HARRINGTON, District Judge.
The matter comes before this Court on a Motion for Summary Judgment filed by defendants as to Counts I and II. This Court has previously addressed and dismissed Count III of the plaintiffs complaint on Defendants’ Motion to Dismiss as to Defendant Baybanks. See Ritter v. Durand Chevrolet, Inc., 932 F.Supp. 32 (D.Mass.1996).
