MEMORANDUM OPINION
NIXON, District Judge.
This action was filed by the named plaintiffs individually and as class representatives seeking declaratory and injunctive relief as well as damages to redress the deprivation of rights secured and protected by 49 U.S.C. § 5(2)(f), 29 U.S.C. § 185(a), 42 U.S.C. § 1985(3), and 28 U.S.C. § 2201. Jurisdiction of this action is based on 28 U.S.C. § 1331 (b), 28 U.S.C. § 1337, 28 U.S.C. § 1343(1), (2), (4), 49 U.S.C. §§ 8 and 9, and 29 U.S.C. § 185(a).
