Appellant, Gunnery Sergeant Mauricio V. Moses, was tried in December 1992 by a *133general court-martial composed of officer and enlisted members assembled at Kaneohe Bay, Hawaii. Pursuant to his pleas, appellant was convicted of violating a Navy regulation and breaching the peace, in violation of Articles 92 and 116, Uniform Code of Military Justice, 10 USC §§ 892 and 916, respectively. Contrary to his pleas, appellant was convicted of attempted premeditated murder and housebreaking, in violation of Articles 80 and 130, UCMJ, 10 USC §§ 880 and 930,…
