Under the provisions of section 222, subdivision 5, of the Penal Law, defendant was indicted for and convicted of the commission of the crime of arson in the second degree. The charge was that on November 30, 1931, in the town of Victor, Ontario county, New York, he willfully set on fire and burned a barn which at the time contained farm implements, including a vehicle for the transportation of manure, such building and the personal property contained therein being insured against loss or damage by fire.
