The appellant challenges the legal sufficiency of evidence upon which he has been convicted of criminal negligence in the operation of an automobile.

At one-thirty in the morning of January 1, 1941, at the intersection of Skillman Avenue and 47th Street in the Borough of Queens, New York City, two passengers in a taxicab were fatally injured when the cab was overturned by "a collision with a. private automobile.
