BACKGROUND

In this matter, plaintiff alleges a breach of contract; breach of an implied-in-fact contract; negligent and fraudulent misrepresentation; and requests punitive damages. This matter stems from the Air Force’s award of a requirements contract to perform cytology services and is currently before the court on defendant’s motion to dismiss and motion for summary judgment and plaintiffs cross-motion for summary judgment.
