On November 15, 1960, plaintiffs 1 and defendant, State of California, entered into a written contract by the terms of which Kenworthy agreed to construct a building and the state agreed to rent it for a term of 30 months. The building was never built. Kenworthy, contending that the state’s breach of contract prevented him from building, brought this action to recover his alleged loss of profits.
