GANEY, Circuit Judge.

Plaintiff brought an action under § 301 (a) of the National Labor Management Relations Act, 29 U.S.C.A. § 185(a), for breach of an alleged labor agreement. The District Court granted defendant’s motion to dismiss the action on the ground that there was no such agreement existing between the parties. Plaintiff appealed.

The complaint, filed October 16, 1961, avers: Plaintiff, Roadway Express, Inc., is a common carrier for hire and maintains a number of trucks and freight terminals in many areas throughout the United States, and is engaged in an industry affecting interstate…
