BRYAN, Circuit Judge.

W. B. Hogue, a citizen of Mississippi, brought suit in a court of that state against his wife and the Strieker Land & Timber Company, a Louisiana corporation, to remove a cloud upon the title to land bordering on the Mississippi river which he claimed to own and which he alleged is located in the state of Mississippi. The Strieker Company was not served with process, hut it appeared pursuant to an order issued under section 57 of the Judicial Code (28 USCA § 118), procured an order of removal to the federal District Court for the Southern District of Mississippi, and…
