BEAUCHAMP, Judge.
Appellant was assessed a penalty of three years in the penitentiary on a charge of theft.
The issues of law involved in this case are not very clear due to the fact that both the prosecuting witness and the defendant testified largely to conclusions which are more confusing than helpful. It is certain however, that there was a sharp disagreement between them as to the trade which was made between Mr. Anderton and appellant which gave appellant possession of about sixty-five head of cattle, mostly small calves.
