Appeal from an order of the Supreme Court (Canfield, J.), entered May 25, 1995 in Rensselaer County, which granted plaintiffs’ motion for partial summary judgment on the issue of liability against defendant Joe Cantanucci and denied a motion by defendants William Bornt and Edward Bornt for summary judgment dismissing the complaint against them.
