Plaintiff-appellant Phillip Breuer sued defendant-appellee Jim’s Concrete of Bre-vard, Inc. in Florida state court for unpaid wages, liquidated damages, pre-judgment interest, and attorney’s fees under the Fair Labor Standards Act of 1938 (“FLSA”), 29 U.S.C. § 201, et seq. Jim’s Concrete removed the case to federal court pursuant to 28 U.S.C. §§ 1441, 1446, and Breuer subsequently moved to remand it back to state court. The United States District Court for the Middle District of Florida (Nimmons, J.) denied the motion for remand. An interlocutory appeal was certified. We affirm.
