Memorandum:
Suits under the Fair Labor Standards Act, 29 U.S.C.A. § 201 et seq., may be commenced in either federal or state courts. State of Missouri ex rel. St. Louis, Brownsville & Mex. Ry. Co. v. Taylor, 266 U.S. 200, 45 S.Ct. 47, 69 L.Ed. 247 (1924). Plaintiffs brought this action to recover damages under the Act in the 113th District Court of Harris County, Texas, and defendant removed to this court. Plaintiffs now move to remand. The sole question presented is whether a suit filed under the Act in a state court may be removed to a federal court. This court holds…
