A jury found appellant, Daniel G. Cebuhar, guilty of third degree assault on a peace officer (Neb. Rev. Stat. § 28-931 (Reissue 1995)), first degree criminal trespass (Neb. Rev. Stat. § 28-520 (Reissue 1995)), and third degree assault (Neb. Rev. Stat. § 28-310 (Reissue 1995)). Cebuhar appeals, contending the district court erred, inter alia, in failing to instruct the jury that a defendant must know that his victim is a peace officer in order to be found guilty of third degree assault on a peace officer.
