The complaint of the appellee against the appellant, filed August 12, 1904, contained two paragraphs. In the first it was sought, in the ordinary short form, to quiet the appellee’s alleged title in fee simple to the west half of the southwest quarter of a certain section of land in Noble county, excepting sixty acres off of the south end thereof. In the second paragraph the appellee sought both to quiet his title to, and to recover possession of, certain real estate described as commencing at a point on the west line of the west half 'of the southwest quarter of said section, thirty chains…
