MEMORANDUM OPINION AND ORDER

FITZWATER, District Judge.

Defendants Texas Tech University (“Texas Tech”), William “Spike” Dykes (“Coach Dykes”), Ronn Reeger (“Reeger”), and Rudy Maskew (“Coach Maskew”) move to dismiss this action by plaintiff Stephen Gaines (“Gaines”), a former Texas Tech football player. 1 Gaines moves for leave to amend his complaint in order to allege claims pursuant to 42 U.S.C. § 1983 for violations of unspecified rights under the United States Constitution.
