Plaintiff was injured in an accident involving two vehicles and a deer on Highway 97 south of Bend in Deschutes County, for which she brought this action for damages against the Administrator of the Estate of the other driver, Bobert Gary ITosey, who was killed in the accident. Each was alone in his respective vehicle; the evidence shows the accident occurred on a straight stretch of highway in a small cut in early *586evening darkness on December 3, 1965.
