Appeal from a supplemental judgment of the Supreme Court (Kane, J.), entered December 19, 1997 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination by respondent Board of Education for *662the Dunkirk City School District denying petitioner’s request for retroactive membership in respondent New York State Teachers’ Retirement System.
