Libelant seeks to recover the sum of $25,000 “for his maintenance, subsistence and cure” for injuries sustained on the voyage of the respondent ship Progress as a seaman on said vessel on or about the 13th day of May, 1936, while at sea in the Alaskan waters. The respondent, answering under special denials, and by way of first affirmative defense, states that prior to the commencement of this action an action was commenced by the libelant in the state court and in which action he sought to recover by way of damages for personal injuries sustained on board vessel…
