In an action to recover damages for medical malpractice, the plaintiff appeals from an order of the Supreme Court, Queens County (O’Donoghue, J.), entered October 5, 2012, which granted the motion of the defendants Jay Gendal and Gendal Kusnitz OBS-GYN, M.D., EC., for summary judgment dismissing the complaint insofar as asserted against them.
Ordered that the order is reversed, on the law, with costs, and the motion of the defendants Jay Gendal and Gendal Kusnitz OBS-GYN, M.D., EC., for summary judgment dismissing the complaint insofar as asserted against them is denied.
