In an action to recover damages for wrongful death and medical malpractice, etc., the defendants Rockland Pulmonary and Medical Associates, EC., Clement Y. Osei, and Stephen Menitove appeal from an order of the Supreme Court, Rockland County *698(Berliner, J.), dated May 29, 2009, which denied their motion for summary judgment dismissing the complaint insofar as asserted against them.
