In this spent nuclear fuel 2 ease, plaintiff Energy Northwest (“EN”) has returned to the Court to seek its damages for the period spanning from September 1, 2006 to June 30, 2012. Pending before the Court are the parties’ respective motions for partial summary judgment. EN seeks summary judgment in the amount of $19.3 million for part of the costs it has incurred to continue to operate and to maintain its dry storage program and for $3.6 million in cask 3 loading costs allegedly incurred as a result of the failure of the Department of Energy (“DOE”) to begin…
