The defendants in error, as devisees of Jonathan Kearsley deceased, brought ejectment against Ready, to recover lot 47, in section 8, according to the Governor and Judges’ plan of the city of Detroit. On the trial they gave evidence tending to show that Ready went into possession as assignee of their lessee; and upon this they claimed that he was estopped from showing title in himself as against them.
