— This action was brought by the plaintiff on a policy of fire insurance, whereby the defendant insured a certain stock of merchandise of the Republic Dry Goods Company at Republic, Ala.
Plaintiff avers the destruction by fire of the insured property, on October 24, 1913; that the interest of the assured in and to said policy of insurance and the proceeds thereof was assigned to plaintiff; and that he is the owner thereof.
