FINDINGS, RULINGS, ORDER AND MEMORANDUM OF DECISION ON THE PARTIES’ MOTIONS FOR SUMMARY JUDGMENT

Introduction

This action came before the court on April 15, 1982 for hearing on the parties’ cross-motions for summary judgment. At issue is the legality of the plaintiff’s simultaneously holding two 'municipal offices to which he was elected on March 6, 1982. For the reasons set out below, the plaintiff is in fact and in law entitled to simultaneously hold the offices to which *497he was elected and judgment is to so enter.
