This matter is before the court on plaintiff Activision TV, Inc.’s (“Activision”) motion for a preliminary injunction pursuant to Fed.R.Civ.P. 65. Filing No. 8. Activision asks the court to permanently enjoin the Attorney General for the State of Nebraska from enforcing a cease and desist order entered by him on July 18, 2013, *1161Filing No. 7, Ex.
