This is an appeal from a judgment of the district court granting a new trial based on misconduct of the jury.

The appeal stems from an action for the recovery of damages resulting from an automobile collision. The plaintiff was injured while a passenger in the taxi cab owned by the Union Cabs, Inc., which was being driven by the defendant, Jerry H. Sonders.
