The City of McKeesport (City) and City officials appeal from an order of the Court of Common Pleas of Allegheny County (common pleas court) that granted the request of Helen J. Hutskow (Hutskow) for a writ of mandamus directing the City to pay Hutskow her pension as the widow of a retired City police officer including a portion of an increase her husband was receiving pursuant to the Special Ad Hoc Municipal Police and Firefighter Postretirement Adjustment Act (Act 147). 1 The questions presented are whether, where Act 147 directs municipal retirement systems to pay an…
