1Opinion of the CourtAlexander, J.
Robert Clark obtained a judgment against the Red Top Cab Company, Inc., in the sum of $2,350 for injuries alleged to have been sustained from an assault committed by a driver for the cab company. Thereupon writ of garnishment was issued to the appellant to enforce the liability alleged to exist under a certain indemnity policy in which the cab company was the insured. The questions herein discussed were litigated under the issue raised by appellee in his contest of the answer of garnishee disavowing any indebtedness or liability to the cab company under its policy.
