On December 20, 1980, a complaint was filed in the Associate Division of the Circuit Court of Howell County alleging movant violated § 195.020 by selling marijuana. He counseled with an attorney in Springfield. His attorney reached a plea agreement with the prosecuting attorney. Mov-ant waived a preliminary hearing. On August 3, 1981, without the presence, but with the knowledge of his attorney, he entered a plea of guilty.
