RAINEY, Chief Justice.

This suit was instituted by C. L. Mc-Collough as guardian of Lulu May, Irvine and George McCullough, minors, against Lulu May Murph and husband, and the United States Fidelity Company of Baltimore, Maryland, for the sum of $3,000, alleged to have been received by the said Lula May Murph as former guardian of said minors, the said company being surety on her guardian’s bond. Lula May Murph made no defense. The said company answered that $500 had been used in the maintenance and education of said minors and the remainder, $2,500, had been lost by the failure of the bank at…
