DENMAN, Associate Justice.

L. C. Blackwood, guardian, having presented in the probate court for approval his final account as guardian of William Blackwood and others, and said court having disallowed same, he appealed to the District Court, and said court, having affirmed the judgment of the County Court, filed conclusions of law and fact, which, as far as necessary to an understanding of the question before us, are as follows:
