— Appeal by defendant from a judgment of the Supreme Court, Queens County (Rotker, J.), rendered October 26, 1983, convicting him of four counts of criminal facilitation in the fourth degree, upon a jury verdict, and imposing sentence.

Judgment affirmed and matter remitted to the Supreme Court, Queens County, for further proceedings pursuant to CPL 460.50 (subd 5).

Pursuant to defense counsel’s request, the trial court charged criminal facilitation in the fourth degree as a lesser included offense of grand larceny in the second degree and attempted grand larceny in the second degree. Defendant…
