Linda Kilpatrick was terminated from her position as a kennel worker by the Delaware County Society for the Prevention of Cruelty to Animals (“S.P.C.A.”). Her complaint alleged that she was fired because she reported an occupational health hazard to the Pennsylvania Department of Agriculture. Count I of her complaint alleged that the termination violated her first amendment rights. Count II alleged the common law tort of wrongful discharge.
