{¶ 1} This is a direct appeal from a judgment dismissing a complaint for a writ of mandamus. The writ was requested to prevent disenfranchisement of voters who voted by provisional ballot at the November 2, 2004 general election.
{¶ 2} On October 29, 2004, appellee J. Kenneth Blackwell, the Secretary of State of Ohio, issued Directive 2004-48 to all Ohio county boards of elections. In that directive, Blackwell specified the requirements for counting provisional ballots in the official election canvass.
