This motion by defendant for an order dismissing that portion of the complaint in this action for a divorce which seeks custody of the infant children of the marriage raises the question whether the Uniform Child Custody Jurisdiction Act (Domestic Relations Law, § 75-a et seq., L 1977, ch 493) (the "Act”) can be retroactively applied to an action commenced prior to its effective date.
